3.3. Data Security: The platform safeguards user data by implementing the latest security protocols but is not responsible for data breaches caused by third parties or user negligence.

3.4. Data Ownership: Facial data uploaded by users is only stored for a certain period necessary for the search and will be deleted according to the platform’s privacy policy or upon user request.

4. Use of Services and Features

4.1. Facial Search: Users can upload a photo of their face to help find photos in a particular event album. The uploaded photo will be analyzed to find matches in the album uploaded by the photographer.

4.2. Photo Purchase: After finding the appropriate photo, users can make a purchase according to the price set by the photographer. Each purchase transaction is final and non-refundable, except under certain conditions set forth in the refund policy.

4.3. Rights to Photos: Users may only use purchased photos for personal use, unless explicitly permitted by the photographer or copyright holder for other uses, such as commercial purposes.

5. User Rights and Obligations

5.1. Responsibility of Use: Users must use this feature in good faith and only to find photos of themselves. Users are not allowed to use this feature to track or find others without permission.

5.2. Payment: Any photo purchase must be made through the payment methods available on the platform. Users are responsible for transactions made and must ensure that payments are made correctly.

5.3. Prohibition of Misuse: Users are prohibited from altering, distributing, or reselling photos downloaded from the platform without permission from the photographer or copyright holder.

6. Photographer Rights and Obligations

6.1. Copyright Ownership: Photographers declare that they own the rights to the photos uploaded or have received permission from the copyright owner. The platform is not responsible for any copyright violations that may occur.

6.2. Photo Upload Conditions: Photographers must ensure that uploaded photos do not infringe on others' privacy rights, intellectual property rights, or contain inappropriate content. The platform reserves the right to remove content that is deemed to violate policies.

6.3. Pricing: Photographers have the right to set prices for each photo uploaded. The platform is not responsible for the prices set and only facilitates transactions between photographers and users.

7. Limitation of Liability

7.1. Facial Recognition Accuracy: The platform cannot guarantee 100% accuracy of the facial recognition feature. Search results may not always be accurate or suitable.

7.2. Service Reliability: The platform will strive to keep the service active and functioning but is not responsible for disruptions or losses caused by technical issues or maintenance.

7.3. Limitation of Damages: The platform is not liable for any direct, indirect, incidental, or consequential losses resulting from the use of the service.

8. Law and Dispute Resolution

8.1. Governing Law: These terms and conditions are governed by the laws applicable in the territory where the platform operates.

8.2. Dispute Resolution: In case of a dispute, users and the platform agree to resolve it through negotiation or mediation first. If the dispute cannot be resolved through mediation, it will be resolved through legal proceedings in the competent court.
